CONDITIONS OF SALE AND RETURN
General provisions and definitions
These general conditions of sale regulate the sale of the products of the Azienda Agricola Miceli Gioacchino (hereinafter “Azienda”) - with headquarters in via G. Rotolo n. 46, 90025 Lercara Friddi (PA), Italia, VAT number: IT05942810820, REA number: PA 286390, PEC: lamennula@pec.it; as part of a distance sales system through the e-commerce website www.contradacoste.it and www.aziendagricolamiceli.it (hereinafter webshop).
By sale contract we mean the distance contract that is the legal transaction having as object goods and/or services stipulated between a supplier, in this case the Azienda, and a final consumer within the webshop.
The final consumer means the natural person who purchases goods and services for purposes that cannot be referred either directly or medically to any professional activity carried out.
By product(s) we mean artisanal food products made exclusively by the Azienda.
Acceptance of the general conditions of sale
These general conditions of sale are valid from the day of publication of the webshop and may be updated, supplemented or modified by the Azienda at any time, becoming effective for the future. In this case, the Azienda will take steps to notify users via the webshop.
The customer by accessing the platform, will be able to conclude the contract for the purchase of the desired product(s), following the instructions and procedures required for completing the order.
These conditions must be examined online before completing the purchase procedure, the forwarding of the order confirmation therefore implies full knowledge of them and their full acceptance.
Object of the contract
Through the webshop, the Azienda offers an online sales service of high quality food products such as extra virgin olive oil, preserves, sauces, marmelades, jams and legumes made directly by the Azienda.
Sale price and shipping costs
All sale prices of the products displayed and indicated in the webshop constitute public offer, and they are expressed in EUR and include VAT.
The shipping costs are not included in the purchase price, but they are indicated and calculated at the time of the purchase conclusion before the payment. The costs are variable, depend on volume, weight and destination country: to know the exact shipping costs simply add the products to the cart and continue.
Payment and billing
All prices are indicated in the webshop include VAT. The minimum order is 30 euros. A regular tax receipt with separate VAT rate will be sent for each purchase. In order to provide a regular invoice, it’s necessary to indicate on the order form the personal data or company name (with VAT number). Payment can be made with:
- Paypal;
- Credit card;
- Bank transfer (in this case the shipment of the products will be taken over only after receiving the payment confirmation from our bank).

Delivery
The Azienda accepts orders to be delivered in Italy and in the countries of the European Union (Austria, Belgium, Bulgaria, Cyprus, Croatia, Denmark, Estonia, Finland, France, Germany, Greece, Ireland, Latvia, Lithuania, Luxembourg, Malta, the Netherlands, Poland, Portugal, the Czech Republic, Romania, Slovakia, Slovenia, Spain, Sweden and Hungary*).
* Regarding the delivery to Hungary, there is the possibility of placing an order without additional shipping costs with the collection option upon agreement in the city of Fót and/or Budapest, in this case we can deliver the products after collecting multiple orders together so delivery times may be a little longer. For deliveries in the neighboring municipalities of Lercara Friddi (for a radius of 60 km away) there is the possibility of making home delivery upon agreement by sending us an e-mail to info@contradacoste.it or by calling us at the number + (39)3491452528.
If you want to order from a country that is not part of the European Union, you need to request a personalized quote. After filling in the data requested on this page, you must choose the "Request a quote" option. As soon as we have received your request, we will reply to you as soon as possible. Shipping is free for orders over 50 euros in Italy, and 130 euros in European Union countries.
The purchased goods will be delivered in any case within the terms provided for by D. Lgs. 206/2005 (within 30 days). No responsibility can be attributed to the supplier for delayed or non-delivery due to force majeure or unforeseeable circumstances.
The customer is required to verify, upon receipt, the conformity of the product delivered to him with the order placed; only after this verification, and obviously without prejudice to the right of withdrawal, the customer must sign the delivery documents. The unreserved acceptance of the products extinguishes any responsibility of the Azienda in relation to any defects.
Should the product be damaged, adulterated or modified in its organoleptic composition, the Azienda invites the customer not to take or ingest the product itself and to report the damage by e-mail: info@contradacoste.it or telephone (+39) 3491452528.
The Azienda is not responsible for damage caused by taking a product that is adulterated or damaged in its organoleptic composition, due to failure by the customer to verify.
The Azienda is not responsible for damage or delays in delivery caused by the carrier to the products purchased, remaining totally unrelated to the relationship between the carrier and the customer.
The Azienda reserves the right to charge the customer for any additional costs, due to changes made to the delivery address, not promptly communicated.
Product availability
The customer can purchase the products as per the online catalog published in the shop section in the webshop, in the quantities available in stock.
While the Azienda strives to ensure the constant supply of the warehouse, it cannot guarantee the uninterrupted availability of products; in the event of unavailability and payment, to promptly inform the customer and refund the price, without additional charges, within 30 days.
Responsibility
The Azienda no assumes responsibility for inefficiencies attributable to force majeure such as accidents, strikes and/or lockouts, earthquakes, floods and other similar events that prevented, in whole or in part, from executing the contract within the agreed time frame.
The Azienda will not be liable to any party or third party for damages, losses and costs incurred as a result of the failure to execute the contract for the reasons mentioned above, as the customer is the final consumer the only right to a refund of the price paid.
The Azienda is not responsible for any fraudulent or illegal use by third parties of credit cards, checks and other means of payment, upon payment itself. As already stated, the Azienda, at no time during the purchase procedure is able to know the buyer's credit card number which, by opening a secure connection, is transmitted directly to the banking service manager.
Right of withdrawal
Pursuant to art. 64 D. Lgs: 206/2005, if the consumer for any reason is not satisfied with the purchase made, has the right to withdraw from the stipulated contract, without any penalty and without specifying the reason, within 14 days of receipt. of the product by sending an e-mail to the following e-mail address: info@contradacoste.it. The consumer can exercise the right of withdrawal by returning the intact product received in its original packaging and obtaining a refund of the price paid. In case of purchase of a package consisting of several units (for example a package of three cans of product), the Azienda guarantees the consumer the right to withdraw and, therefore, to return what has been purchased, even if he has already opened and consumed one of the individual units that make up the package. In this case, since it is a perishable and non-storable product, the withdrawal will be valid only for the units that have remained intact, for which, once returned, according to the methods indicated above, the customer will be refunded the price paid. In any case, the deadline for the return is 10 days from the exercise of the right of withdrawal. In all cases other than that indicated above to exercise the right of withdrawal, the product must be returned intact (therefore not opened, tampered with, adulterated).
The consumer must return the product to the Azienda's address within 14 days of receipt of the goods. The product is considered to be returned when it is delivered to the accepting post office or to the forwarder.
The return takes place under the full responsibility of the customer until the company confirms that the product has been received. The customer is liable for any damage that the product may suffer during transport. The Azienda is not responsible in any way for any damage, theft or loss that may occur during the return transport of the goods returned by the customer. The costs of returning the product are charged to the customer.
The refund will be made through the transaction reversal procedure (if payment made by the customer with credit card or PayPal) or by bank transfer (if payment made by the customer with advance bank transfer). In the latter case, it will be the customer's responsibility to promptly provide in writing (eg also in the same notice of withdrawal), the bank details on which to obtain the reimbursement (IBAN code and name of the account holder) to allow the Azienda the refund.
If the withdrawal has not been exercised in accordance with the above conditions and the provisions of art. 64 and ss. “Codice del Consumo”, in case that the product is not intact, it will not result in the termination of the contract and, consequently, will not give the right to a refund of the amount paid by the customer for the product. The product will remain at the Azienda and will be made available to the customer for collection which must take place at his expense and under his responsibility. Likewise, in the event that the product is damaged during transport, as the condition of the integrity of the product does not exist, the request for withdrawal will be refused. The Azienda will notify the customer of the incident within 5 working days of receipt of the products, to allow him to exercise the rights of the customer under the transport contract. The product will remain at the Azienda and will be made available to the customer for collection at his expense and under his responsibility.
